Toronto’s Commercial List is a specialized court of the Ontario Superior Court of Justice. It has a dedicated roster of judges highly specialized in commercial disputes. If you are a litigator practicing in Toronto, you will likely come in contact with the Commercial List from time to time. Join our panel discussion about Commercial List ‘basics’ and get some top tips for effectively representing your clients.


Justice Markus Koehnen and Heather Meredith will share their experience and insights on:

  • Unique procedural aspects of the Commercial List
  • Putting the ‘three Cs’ of the Commercial List into practice, and
  • Tips for making your client’s case effectively in ‘real time’ litigation

Justice Markus Koehnen Read his bio

Before being appointed to the bench, Justice Markus Koehnen practised complex commercial litigation at McMillan LLP for 29 years, during which he appeared before courts of all levels, securities commissions, and international arbitration tribunals. His practice led him to work with a wide variety of legal and social cultures, including those of China, Iran, and Nigeria. He was active in the International Bar Association, where he served as chair of the Litigation Committee. Justice Koehnen is the author of Oppression and Related Remedies, which has been cited frequently by courts throughout Canada, including the Supreme Court of Canada. In addition, he has contributed to various books dealing with director and officer liability, privilege, and arbitration. Justice Koehnen earned a B.A. and LL.B. from the University of Toronto and a diplôme d'études approfondies in international economic law from the Université Paris 1 (Panthéon-Sorbonne). He is a Fellow of the Chartered Institute of Arbitrators and a long-time contributor to the director education program run by the Institute of Corporate Directors and the Rotman School of Management. Justice Koehnen's wife came to Canada as an Ismaili refugee from Uganda. They have two children and live outside Toronto.

Heather Meredith, Partner, McCarthy Tétrault LLP Read her bio

Heather Meredith is a partner in McCarthy Tétrault’s Bankruptcy & Restructuring Group in Toronto. Recognized for her in-depth industry knowledge, upfront and direct legal style, and solution-oriented approach, her practice focuses in the areas of commercial insolvency, restructuring, bankruptcy and related litigation. A highly regarded advisor, Heather regularly represents a broad array of stakeholder groups in commercial restructuring proceedings including debtors, secured creditors, landlords, suppliers, monitors, trustees, and receivers. Clients value her creativity and trust her strategic advice and innovative guidance, each of which she uses to pursue their objectives.

Stephen Brown-Okruhlik, McMillan LLP Read his bio

Stephen is a partner in McMillan LLP’s litigation group in Toronto. His practice focusses on complex commercial disputes, including insolvency litigation and disputes between corporate stakeholders. He also helps guide clients through contract disputes related to corporate mergers and acquisitions. Stephen appears regularly before the Commercial List Court in Toronto.
